The more sane way to interpret this is that it’s a small enough portion of their subscriber count that they really don’t need to be bitching about 5%.
I think any experiment that could potentially filter out bad faith participants is at least worth a try. I participate in political discussions pretty infrequently, but when reading them I often see users jumping in with a ridiculous viewpoint that they are completely unwilling to discuss or hear any flaws about. That’s not conversation, that’s trying to shout others down, and I will be interested to see if that kind of behavior gets caught by your bot.

Money is already involved. It doesn’t need to be personal profit, my understanding is the lost sales are already enough for a copyright infringement claim. Although there are also three counts related to DMCA circumvention/trafficking – seems to me like Nintendo is confident they can prove in discovery that the defendant was close with / a part of the groups involved. (I am not a lawyer)
