I think it’s also a test to see if the courts or institutions can create any consequences for the homeland enforcement arm disappearing anyone, including those with clear legal status and protections.
because at a certain point, possibly already behind us, they can just target and vanish anyone they don’t like into the El Salvadorian concentration camp and claim nothing can be done to recover them after the handover. just toss the documents in the burn bag, claim whatever they want, put a hood on them, and put em on a plane.
its a step beyond camp x-ray where the incarcerated had no legal status but did exist in US custody, and the US eventually had to produce them for the courts (like Mohamedou Ould Slahi, who was eventually released).
honestly if they pull this off without any consequences after creating the option so quickly, it’s some real Operation Condor type boomerang shit, and the sky is the limit on political disappearances.
