      Eh, I don’t think they give a shit about the natives to be honest. There isn’t enough of them to warrant the attention.

      This is just regular old racism. Anyone with a slight tan to their skin can be whatever the authorities decide they are. Once that is normalized they can expand it to include other ‘undesirables’ until eventually everyone is included.

      The first piece of legislation passed by the newly formed California government was the “Chinese Exclusion Act” which among other things,

      “prohibiting all immigration of Chinese laborers for 10 years… The Act also denied Chinese residents already in the US the ability to become citizens and Chinese people traveling in or out of the country were required to carry a certificate identifying their status or risk deportation. It was the first major US law implemented to prevent all members of a specific national group from immigrating to the United States, and therefore helped shape twentieth-century immigration policy.”

      Let’s not just limit it to native Americans and Californios(native Mexicans who lived in California before it was stolen), that racist core of the US has been there since day 1. A contributing factor to a lot of the westward migration in the US was that “lower ladder” white immigrant national groups like the Irish, Italian and others who were bottom rung on the east coast could move West and finally have someone further down the ladder to kick.

      This is one of the sustaining reasons for racism in general used to manipulate groups who feel tenuous control and power in a society; give them a line about an “other” group, tell them they’re better than that group and wham, you have folks ready to kill to preserve their perception of a precious advantage in society–when of course in reality they’re no better and in fact worse off as the weak fall or rise together.

      If you are interested in learning more, the history of California is incredibly useful as a proxy to understand why certain legislation, perceptions and other things still alive in the US that propagate racism exist. Look at immigration quotas the US sets for different nations for example; much, much higher in predominantly white, western European nations while Asia (see California influence), despite MUCH larger populations are allowed lower numbers of immigrants/refugees, visas, etc.

      these guys are AMAZING at turning what ought to be a citation and a fine into a full blown arrest + jail time via being generally disruptive, uncooperative, wasting the court’s time on complete legal nonsense and overall idiocy.

      There’s -several- youtube channels making a living out of reporting and commenting these cases.

        I mean Native American tribes are literally sovereign nations within the US so I’ll give them a pass if that is what it was.

        Regardless please explain under what circumstances it is necessary to not only take someone’s freedom for 2 months but to also have the tax payers pay for their detainment all over a suspended license?

          It’s not necessary to keep them 2 months in jail, they do it to themselves.

          Normal people, when they get arrested by a police officer, provide their ID, take whatever citation, pay the fine, and then move on.

          Meanwhile, the typical interaction with a sovtard goes like this

          Police officer “Hello sir, we stopped you because you were over the speed limit, and it seems your plates are expired, can you provide me with id, drivers license, proof of insurance?”

          Sovtard: <insert nonsense about traveling not in commerce, maritime law, morrocan kings, etc.>

          Police officer: “Please provide me with id, drivers license, proof of insurance, so I can give you a citation and we go our merry way”

          Sovtard: <insert nonsense about not contracting, black’s law dictionary, judges are a corporation, etc.>

          Police officer: “You are legally obliged to provide these, if you don’t, it’s obstruction, and you’ll be arrested”

          Sovtard: <insert nonsense about bonds, secret bank accounts with trillions of dollars, etc.>

          Police officer: <arrests sovtard, searches car, finds ID - runs it: no insurance, suspended license, etc.>

          This goes on and on and on in front of judges the same pattern applies. Challenge jurisdiction every 15 minutes, refuse legal counsel, refuse to plead, ‘I am the living Man’, constantly interrupt the court’s proceedings, fuck up at every corner, waste time with, general incompetence, general stupidity, ‘I am not the allcaps representation of my name’, etc etc

          This is why these idiots spend 2+ months in jail over a citation and a ticket. They watched a youtube or tiktok retardfluencer selling them legal nonsense, bought it hook line and sinker. Some even go and surrender their driver’s license if they had any, cancel their insurance, buy “PRIVATE not for commerce” license plates.

          It’s full blown stupidity.

            i think what you’re doing here is rationalizing our fucked up legal system.
            2 months over a suspended license isn’t unheard of… if it was suspended over a dui, she was on probation, or she had multiple offenses….
            and of course, her skin is brown.
            them sovcits are dumb but they’re not really that common

              I’ve watched videos of sovcits somehow managing to make their arraignment (a normally short procedure where you simply get told the alleged charges, the potential penalties, get asked if you understand them, and what do you plead, and whether you wish to proceed for a jury or a bench trial) last hours

              Sovcits usually decide to go for jury trial (because you can’t make law from the bench or something…) over something that’s a ticket, which, well, take time. Time they spent in jail, because they were arrested for obstruction in the first place. When they get released on bond, they violate their bond and don’t show up in court and then get issued a bench warrant and end up in jail.

              Sovcits do everything that can be done to end up in jail, and then act shocked when that happens.

                Of course not all sovcits are the same. But I have heard the real ones are no fan of these youtube wannabe sovcits. That said. Sounds like they are playing on the judges egos. There is a default answer to all of those initial questions if the person refuses to answer with y/n or guilty/not… The judge doesn’t have to lets it last for hours. But from my and others I knows experience with judges and jury duty, judges seem to be more than happy to waste time telling people how they should be respected and such. I am sure not all judges are like that of course. But they seem to be hell bent to establish thier power over people. Even at conferences outside the courthouse. The job doesn’t seem to attract a humble bunch.

                  It’s not about ego.

                  Rulebooks that pertain to court things are hundreds of pages long in a bid to be fair and equitable for everyone. Things are done in a way for a reason, you can’t just yolo justice. At an arraignment, the judge needs to determine a couple things:

                  • that you are who the person the prosecutor actually brings to justice
                  • that you know your rights
                  • that you understand what you are being charged with
                  • that you understand what are the potential penalties
                  • what do you plead
                  • a bunch more stuff

                  This is to prevent shenanigans

                  if the first step already takes 30 minutes because you refuse to even give your name, then when you finally ID yourself, you then proceed to constantly interrupt, delay, whinge, contest, refuse to understand, be a living man of morroco, etc, all the way when it’s time to plead and you spend an extra 45 minutes being like “I wish to be left alone” instead of pleading… then yeah. Either the judge takes the time for you to run out of bullshit and the arraingment ends with you arraigned, or they have a full docket and will send you to jail for contempt and try again the next day.

              It’s a thing they put themselves through. They get themselves arrested for obstuction, and then delay everything by continuing the sovcit nonsense.

                Yeah still not very convincing. Can you demonstrate they were also stinky? Then I may consider your point.

                But in all seriousness, there’s no reason to keep them. In prison. Release them from jail and if they don’t show up issue a warrant. This isn’t a big deal at all. I’d rather someone get away with having a suspended license than spending tax payer money on this.

                Plus let’s back up for a second. We have no evidence that this is even what happened in this case. You got on your soap box rather quickly

                  She might very well not be a sovcit. I wouldn’t bet on it though. You don’t spend that long in jail over a suspended license unless you do something excessively stupid in the process.

                  But in all seriousness, there’s no reason to keep them. In prison. Release them from jail and if they don’t show up issue a warrant.

                  Sovcit are not in jail because of the suspended license, but for the obstruction charges. They then stay in there because legal things take time, and the fact they do everything you shouldn’t be doing if you want to get out of jail.

                  It’s stupid, but it is what it is.

            Those “Private Not for Commerce” plate make me laugh every time I see them. I work in freight and every time someone shows up with those to pick up their freight I can’t give them their freight due to DOT.

            They also almost always don’t have a valid license of any kind as well, which means that even if they did show up in a valid vehicle I can’t release it because I can’t confirm the identity of whose picking it up.

            I’m paid by the hour so I have a right proper giggle every time explaining it to them.

          being disruptive and uncooperative (eg, failing to provide ID, license, proof of insurance) during a traffic stop will land you in jail for obstruction. It’s the sovcit play. This is how they end in jail.

          being disruptive in court is also a good way to end up in jail for contempt

          They then spend more and more time in them by doing the whole time wasting thing, refusing legal counsel, bringing up fake legal rulings, etc.

        It did say suspended license. My understanding is that to claim sovcit you can’t ever have a license. But that might be specific to my state. We have some of the real sovcits. They were sovcits before the internet existed. Very very few of them left though.

          your first mistake is trying to understand. Do not understand, never stand under.

          Sovtard joke asides, it doesn’t actually matter to these single-braincelled organism. They just decide laws don’t apply to them. Some go even all the way to get their driving licenses revoked.

            Yeah, this is true of anyone making life changes based on the advice of youtubers. Most people are just trying to take control of thier life from all the constraints society and capitalism puts on them to extract as much gdp from them as possible. If thier lives were stable and fullfilling, they wouldn’t feel the need to listen to the youtubbers.

    A day before Arizona native Leticia Jacobo was scheduled to be released from an Iowa jail, her mom visited to verify pickup details with the staff. Ericka Burns was excited to drive her daughter home after spending a month apart and wanted to make sure Jacobo wasn’t forced to wait a minute longer than necessary.

    But jail staff told Burns that Jacobo wouldn’t be let go because she would be turned over to immigration agents — even though Jacobo is Native American.

    The 24-year-old was born in Phoenix and is a member of Arizona’s Salt River Pima-Maricopa Indian Community. She was booked into the Polk County Jail in Des Moines, Iowa, where she currently lives, in September for allegedly driving with a suspended license. Jacobo was scheduled to be released on Nov. 11, but what should have been a routine process was complicated and delayed by an erroneously issued ICE detainer. She was ultimately allowed to leave just before 4:30 a.m. on Nov. 12.

    Maria Nunez, Burns’ sister, said that it was terrifying to be told that Jacobo would be taken by federal agents, especially because no one appeared willing to correct the mistake at first.

    “My sister said, ‘How is she going to get deported if she’s a Native American?’ and ‘We have proof,’” Nunez recounted. “They said, ‘Well, we don’t know because we’re not immigration and we can’t answer those questions. We’re just holding her for them. So, when they pick her up tonight they’re going to go ahead and deport her to wherever they’re going to take her, but we have no information on that.’”

    Jacobo’s family quickly mobilized, with just hours left on the clock before jail staff said she would be transferred into federal custody. The Veteran’s Day holiday resulted in several communication dead ends. Desperate for some kind of help, Jacobo’s aunts, both in Arizona and Nebraska, put out calls for help via Facebook and connected with local tribal leaders. Ericka took a copy of Jacobo’s birth certificate to the jail and stayed on site to make sure ICE didn’t take her daughter.

    Lt. Mark Chance, a spokesman for the Polk County Sheriff’s Office, which oversees the jail, said that the ICE detainer against Jacobo was the result of a clerical mix-up and was intended for a different person who was booked in the jail at the same time. ICE agents requested a detainer be placed on that person, but a mistake resulted in it being put on Jacobo’s file, instead. Chance said that “internal” discussions would likely be had about how to prevent similar problems in the future.

    “It was human error, but I’m sure as soon as the command staff find out about it, they’re going to have some meetings with their supervisors internally and be like, ‘Hey, guys, we gotta keep our thumb on this, this is silly,’” Chance said.

    What’s an ICE detainer?

    Polk County Jail has a 287(g) agreement with U.S. Immigration and Customs Enforcement. That partnership authorizes local law enforcement officials to perform some immigration enforcement functions, including preparing removal paperwork, interrogating people who have been arrested about their citizenship status and comparing their biographic information against U.S. Department of Homeland Security databases to identify people who may be eligible for deportation. The purpose of the program is to cut down on the investigative legwork for ICE and increase deportations.

    Police officers trained under the 287(g) program can issue ICE detainers based on the information they’ve gathered or at the written request of federal officials. Detainers allow a person in custody to be held for an extra 48 hours after their scheduled release time, even if they have not yet been convicted of a crime, to give ICE agents time to take them into custody.

    Because detainer requests don’t require probable cause and aren’t mandatory in the same way that judicial orders are, some law enforcement agencies choose to ignore them, wary of the legal consequences. The courts have ruled that detainers are potentially unconstitutional because they result in prolonged imprisonment, and multiple lawsuits have been filed after detainers were issued against U.S. citizens.

    The use of detainers has come under new scrutiny amid President Donald Trump’s mass deportation campaign, which has seen a massive spike in their issuance. Within the first two months of Trump taking office, the rate of detainers issued on a daily basis jumped by 72% compared with the first two months of Biden’s presidency.

    Mistake or discrimination?

    Jacobo’s ordeal highlights the fallout of aggressive immigration enforcement for Native Americans. In January, Navajo Nation officials reported more than a dozen Indigenous people in Arizona and New Mexico had been questioned or detained by federal immigration authorities.

    Nunez told the Arizona Mirror she was skeptical that the mix-up was nothing more than a misunderstanding, and that discrimination wasn’t involved at least to some degree. She noted that Jacobo had her tribal identification with her, had been fingerprinted, had her Social Security number on file and has been booked into the same jail more than once.

    “I do want to say that it’s racial profiling because she’s been there before, they have a rap sheet on her — why would they make a mistake with someone that’s constantly coming in?” Nunez asked.

    She added that her sister is considering further legal action and said that she’s concerned about the potential for future harm. Not everyone has a family as involved in their welfare as Jacobo does, she pointed out. Jacobo herself wasn’t informed about the detainer against her, despite it being placed on her file a week earlier, on Nov. 4.

    The ICE field office for the midwest region did not answer questions about whether they verify existing detainers for accuracy or what their processes are for ensuring Native Americans aren’t being detained.

    “I’m just so happy that we caught it and we know what’s going on and she’s not alone in this,” Nunez said, before Jacobo was released. “I just hope it doesn’t ever happen to someone else, with them not knowing they’re going to get deported.”
